REGULATIONS FOR THE PROVISION OF EMPLOYMENT MANAGEMENT AND JOB PLACEMENT SERVICES
These regulations establish the terms and conditions under which Laborintos S.A.S. provides Employment Management and Placement services.
DESCRIPTION OF THE LEGAL ENTITY
Laborintos S.A.S., a legal entity identified with NIT # 900.589.886-1, is a company legally incorporated under the laws of Colombia in accordance with the corporate type of simplified joint stock companies, with legal and commercial domicile at Avenida Carrera 15 No. 88 - 64 Office 605, in the city of Bogotá D.C.
Laborintos S.A.S. provides Employment Management and Placement services in all types of industries, specializing in middle and lower management positions.
The hours of operation are Monday through Friday from 8:00 am to 12:00 noon and from 1:00 pm to 5:00 pm.
The website is: www.laborintos.com and will be accessible to the public 24 hours a day, but applications will only be processed during the hours described above.
1.1. TYPE OF PROVIDER
Laborintos S.A.S. is a private for-profit Employment Management and Placement Agency.
MANAGEMENT AND PLACEMENT SERVICES
2.1. BASIC MANAGEMENT AND PLACEMENT SERVICES
Basic Employment Management and Placement services are understood to be the following services aimed at linking supply and demand for employment.
2.1.A. REGISTRATION OF SUPPLIERS, APPLICANTS AND VACANCIES REGISTRATION OF SUPPLIERS
It is the registration of resumes virtually or in person in the computer system authorized to the provider.
Bidders who wish to register their resumes in the Laborintos S.A.S. database must carry out the following steps:
Log in to laborintos.com and go to the Registration and Login button at the top of the web page and enter as a candidate.
If the bidder has not yet registered on the Laborintos website, he/she may do so through the same section by completing the basic user registration form (a valid email address and a password that the user will establish for later access are required).
Once inside your user profile, as a Candidate, you will be able to complete the detailed form to upload your data and resume.
Resumes submitted through this system will be stored in the virtual system of Laborintos S.A.S. for the exclusive use of Employment Management and Placement activities.
NOTES: The basic management and placement services shall always be provided free of charge to the searcher, in accordance with Article 2.2.2.6.1.2.4 of Decree 1072 of 2015.
Resumes will only be received through the mechanism specified in this regulation and the resumes that punctually arrive to our mails without having been registered in the web page will be registered by the administrative assistant in the system to ensure that they are all in the same database.
REGISTRATION OF APPLICANTS AND VACANCIES
It is the registration of the basic information of the employers virtually or in person in the Computer System authorized to the provider.
Job seekers who wish to contract Laborintos S.A.S.'s Employment Management and Placement services must send the provider the basic information of the vacancy (company, position, salary, and context of the vacancy) through one of the following mechanisms:

On the web page: laborintos.com through your user profile, registered as a company or employer. If you have not yet created an account as a company or employer, you must register using a valid email address and a password that the person in charge of each company will establish, for subsequent access.
After logging in as a Company user, you must click on the "Recruit Talent" section, where you will find a form in which you must fill in the necessary information for this purpose.
1. The Claimant makes the request for service to Laborintos, by one of the above mechanisms.
2. Laborintos S.A.S. will provide the Claimant with a commercial proposal, establishing the conditions under which the service will be provided (price, form of payment, process, time and guarantee). The general manager will be responsible for preparing the proposal.
3. Once the Claimant approves the commercial proposal, Laborintos S.A.S., will send a letter of acceptance to the Claimant, who must send it duly signed to formally begin the provision of the service.
4. An understanding is made with the Applicant, where the profile, competencies and scope of the position are specified. This understanding can be carried out at Laborintos S.A.S. facilities, Av. Carrera 15 No. 88 - 64 Office 605.
Laborintos S.A.S., requests the Claimant the necessary documents to perform the necessary verifications, in order to verify that it is a legally constituted company. Once this information is collected, the administrative assistant of Laborintos S.A.S. will proceed to register the Claimant's data in a customer database where we request billing information; NIT, company name, address, telephone, a RUT and a certification of existence and representation which is verified on the website of the Chamber of Commerce.
VACANCY REGISTRATION
It is the registration of vacancies made by the Claimant virtually or in person.
Once the service is accepted by the Claimant, Laborintos S.A.S. personnel will coordinate a face-to-face or teleconference meeting with the Claimant to complete the profile process for the position, using the following information:
- Detailed information about the Claimant (economic activity, market context, person responsible for the process).
- Information about the vacancy (position, responsibilities, functions, studies, experience, required competencies and conditions offered).
- Vacancy registration procedure. Laborintos S.A.S. performs this virtually, making a daily report or each time a request is received from a Claimant, through the FileZilla software to the public employment service, providing the information established in Article 3° of Resolution No. 2605 of 2014 and developed in the technical annex of Resolution 129 of 2015.
CRITERIA FOR VALIDATING VACANCY REGISTRATION
When the information is collected from the Applicant, the following information is requested: Title of the vacancy, description, time of related experience, level of studies required, profession, salary, number of vacancies, city in which the vacancy is required and type of contract. Additionally, it is confirmed with the Applicant if confidentiality of the vacancy is required or if an exception to the publication is made, taking into account that this exception is made only in the following cases:
- Strategic positions
- Special projects
- Management positions in niche markets and industries
- Vacancies that by their nature should not be made public
It should be clarified that the jobs that are occupied and for which the Complainant takes measures to fill them do not constitute vacancies and therefore are not reported in our work as head hunter.
Note: The person in charge of collecting the information is the general manager or the operations coordinator, who sends the information to the administrative assistant to register and upload the daily report information and publish it on the Laborintos website.
Step by step to generate a publication on the Laborintos website:
a. Log in as Administrator in the laborintos.com page.
b. Login with the user and password of the web page administrator.
c. Then click on vacancies, new vacancy.
d. We fill in the information of the vacancy such as title, sector of the company that requires the service, knowledge or indispensable requirements...
e. The "Active" switch is activated
f. Finally click on publish
After following this process, the vacancy becomes visible on the public part of the Laborintos website in the Jobs section https://laborintos.com/empleo/.
2.1.B. OCCUPATIONAL ORIENTATION FOR PROVIDERS AND APPLICANTS
OCCUPATIONAL ORIENTATION FOR SUPPLIERS
It includes the analysis of the seeker's profile, general information on the labor market, information on employability programs and advice on the development of job search strategies through the following instruments:
Laborintos S.A.S. provides employment services at Laborintos offices (Carrera 15 No. 88 - 64 Office 605) or virtually through Skype. These services are offered to labor suppliers.
Laborintos S.A.S. provides the service of orientation to bidders who have been pre-selected as one of the short-listed candidates for a particular vacancy, which is done at the time of the interview. The duration of the feedback can vary from 30 minutes to one hour. This free basic orientation includes:
Verbal feedback on the form and content of your resume, including tips for improvement, is given at the time of the interview for the position with Laborintos S.A.S. consultant.
Verbal feedback on their interview, including tips for subsequent interviews with the Claimant, in case the candidate needs feedback on what was discussed with the Laborintos S.A.S. consultant.
Feedback from psychotechnical tests (Molton Disc).
NOTE: It only applies to candidates who are selected in the final shortlist submitted and approved by the Claimant, which is carried out in person, with a duration of one hour, depending on the availability of the person.

ASSOCIATED SERVICES
Laborintos S.A.S. provides associated services at Laborintos offices (Carrera 15 No. 88 - 64 Office 605) or virtually through Skype. These services are offered to labor providers who are interested in improving their skills and competencies for the job search.
Career Transition Workshop for a High Impact Resume: This is a one and a half hour resume workshop. It specializes in the review and improvement of the resume. During the workshop, the individual's strengths are identified and based on them the resume is rewritten, while the format is reviewed to ensure clarity and impact.
Training for the development of competencies associated with market research and opportunity search: This is a workshop on active strategies for job search, it lasts one hour and introduces the individual to traditional job search methods and the factors to be effective in them, and introduces the concept of active job search (hunting), providing tools to search for vacancies that fit the candidate's profile.
Outplacement Counseling Workshop: For the development of competencies and skills for job interviews. This is a two-hour workshop on effective interviewing. It focuses on the development of tools and skills to face interviews properly, answer difficult questions, have the ability to handle the interviewer and sell yourself in an impactful way. It consists of the presentation of a hypothetical interview and feedback on the quality of answers, body language, handling difficult questions and overall impact.
Outplacement workshop, recognition of leadership styles, strengths and areas of opportunity: This is a preparation workshop for psycho-technical tests. This one-hour practical workshop facilitates the understanding of the types and purpose of the tests used in the labor context. It includes the application of a test that allows us to know the leadership style, motivators, areas of strength, areas of opportunity and the respective feedback regarding the results.

GUIDANCE TO PLAINTIFFS
It is the advice provided to the Applicants (employers) for the definition and registration of vacancies.
During the job profiling, Laborintos S.A.S. guides the Applicant in defining the functions, responsibilities, competencies, training, experience and salary of the vacancy, based on its knowledge of the current market conditions.
This orientation is provided by the general manager or operations coordinator through a face-to-face meeting at Laborintos S.A.S. facilities, at the Job Seeker's offices or by teleconference as established with the Job Seeker at the time of completing the profiling process.
2.1.C. PRESELECTION
It is the process that allows to identify among the registered bidders, those who have the profile required by the vacancy.
The pre-selection service consists of five phases which are developed by the consultants or the operations coordinator of Laborintos S.A.S., these 5 phases are:
Search for resumes: The search for resumes that meet the profile required to fill the vacancy begins in the virtual database referred to in point 2.1.A. of these regulations. This search is complemented through other available recruitment sources such as the elempleo.com web portal, linkedin and databases provided by universities such as the CTP Universidad de los Andes.
Telephone filtering: We contact by telephone the bidders whose résumés meet the required profile to validate compliance with the basic requirements of the position and corroborate their interest in participating in the process.
In-depth and competency-based interview: Those bidders who pass the telephone screening are called for a face-to-face or teleconference interview. In this interview, the competencies of the bidder are evaluated in depth and how well he/she fulfills the profile of the position.
Psychotechnical Tests: Those bidders who successfully pass the interview, take the Molton Disc Psychotechnical Test virtually (an electronic link is sent to them via e-mail).
Final calibration: The findings of the interviews and psycho-technical tests are analyzed to choose the three best candidates for the vacancy.
2.1.D. REFERRAL:
It is the process by which the profiles of pre-selected candidates are sent or made available to the employer.
The resumes of the shortlisted bidders are sent by e-mail to the Claimant, in order for the candidates to be approved by the immediate boss of the vacancy and by the people involved in the process.
Once the approval is granted, a detailed report of each candidate is sent to the Claimant by e-mail, including personal information, work history, candidate's concept and main strengths, together with the report of the Molton Disc tests submitted by the candidate.
Once the candidates are approved by the Applicant and the Applicant wants to proceed with the hiring we validate the candidate's references, before the hiring proceeds. These references are validated with a manager, a peer, human resources or a subordinate of the finalist candidate. This information, as well as an offer form, is sent to the client (the applicant) so that he/she can contact the candidate and make the corresponding offer.
NOTE 1It should be noted that the basic referral service is monitored by the operations coordinator on Tuesdays and Thursdays, in order to manage, follow up and ensure feedback from the Claimant.
NOTE 2If requested by the Claimant, Laborintos S.A.S. may provide the complete process listed in item 2.1 or a fraction thereof (e.g., only "resume search and telephone screening").
NOTE 3As for the candidates not placed, a letter of thanks for their participation in the process is sent to them.

4. INFORMATION PROCESSING
Laborintos S.A.S. is authorized in accordance with the informed consent granted by the job offerers and job seekers, to process the data provided for the provision of the management and placement service, in accordance with the provisions of Law 1581 of 2012. The information provided herein will be used for the purpose for which it was granted and with the restrictions established by Law 1581 of 2012, through its incorporation in the Public Employment Service Information System.

4.1. RIGHTS OF THE OWNERS OF THE INFORMATION:
The Data Subject shall have the right to:
To know, update and rectify your personal data with respect to the data controllers or data processors.
To be familiar with the Service Provision Regulations of the Employment Management and Placement Agency at the time of registration.
Request proof of the authorization granted to the data controller.
To be informed by the Data Controller or the Data Processor, upon request, regarding the use that has been made of their personal data.
To file before the Superintendence of Industry and Commerce complaints for violations of the provisions of this law and other regulations that modify, add or complement it.
To revoke the authorization and/or request the deletion of the data when the processing does not respect the constitutional and legal principles, rights and guarantees.

5. RIGHTS OF JOB SEEKERS AND JOB OFFERERS
5.1. BIDDERS' RIGHTS
Job offerors shall be entitled to:
Receive adequate and quality care at the Employment Management and Placement agency.
To be familiar with the Service Provision Regulations of the Employment Management and Placement Agency at the time of registration.
To be informed about the treatment that the personal data provided to the management and placement agency will receive.
Rectify the information registered in the public employment service at any time.
Receive free basic Employment Management and Placement services.
Be informed about the procedures established for the services you request.
To present complaints and claims to the management and placement agency and that these are attended to within fifteen (15) working days of their presentation.
OBLIGATIONS OF JOB PROVIDERS
The job offerors shall have the following obligations:
Provide truthful information when filling out the resume form.
To inform the management and placement agency when you are not interested in continuing to receive management and placement services.
5.2 PLAINTIFFS' RIGHTS
Claimants shall have the following rights:
To be familiar with the service provision regulations.
Receive an adequate and quality service.
To be informed about the treatment that the data provided to the management and placement agency will receive.
Rectify the information registered in the public employment service at any time.
Receive information about the cost of the services you are requesting from the management and placement agency.
To be informed about the procedure established for the requested services.
To be aware of the actions carried out by the Employment Management and Placement Agency in the development of the service provision.
To present complaints and claims to the management and placement agency and that these are attended to within fifteen (15) working days of their presentation.
OBLIGATIONS OF JOB PROVIDERS
The job offerors shall have the following obligations:
Provide truthful information about the working conditions of the vacancies offered.
To pay the Employment Management and Placement agency the commission or value, when applicable, for the services received.
To inform the management and placement agency when you are no longer interested in continuing to receive management and placement services.
Refrain from using discriminatory or offensive words or expressions in the use of the platform or in the description of vacancies.
All registered vacancies must comply with the regulations established for vacancies according to 129 of 2015 issued by UAESPE.
6. OBLIGATIONS OF THE PROVIDER
The Employment Management and Placement Agency shall have the following duties:
Maintain the conditions and requirements that made it possible to obtain the authorization.
Request authorization for the expansion of its scope of action.
To inform users of the Service Provision Regulations.
Request approval of the amendments to the Service Provision Regulations from the Ministry of Labor.
To provide basic management and placement services free of charge to workers.
To guarantee compliance with the principles of the Public Employment Service in the development of activities.
To provide the services of Employment Management and Placement with respect for the dignity and the right to privacy of bidders and applicants. The processing of your data will be carried out in accordance with the provisions of the Statutory Law 1581 of 2012 and other provisions on the subject.
Ensure that bidders are not offered false or misleading terms of employment that do not meet minimum legal standards.
Ensure the correct relationship between the characteristics of the jobs offered and the occupational, academic and/or professional profile required.
Be subject to the control and inspection actions carried out by the Ministry of Labor in accordance with the regulations in force.
Ensure that registered companies are legally incorporated.
To state such condition in the development of activities as a management and placement agency, as well as in the means of promotion and dissemination of its activity, mentioning the number of the administrative act by which it was authorized, and its membership in the Network of Providers of the Public Employment Service.
To have a computer system for the operation and provision of Employment Management and Placement services. This system must be compatible and complementary with the Information System of the Public Employment Service referred to in Article 13 of this Decree, for the monthly supply, by electronic means, of information on job applications and offers, as well as other activities carried out as an authorized placement agency.
Submit within the first fifteen days of the month, the statistical reports on the management and employment placement carried out in the previous month, in the formats and by the means established by the Ministry of Labor by means of a resolution.
Annually update the amount of the guarantee, taking as a basis the modifications to the legal minimum salary in force and submit the corresponding certificate of renewal and update of the policy referred to in paragraph d. of Article 33 of this Decree, within the first twenty (20) working days following the increase in the minimum salary decreed by the National Government.
Submit, within the first month of each year, the certificate of existence and legal representation issued by the competent authority. When there is a modification in the legal representation of the placement agency, a certificate stating such modification must be submitted within twenty (20) working days following its registration.
Submit to the Ministry of Labor, the statutory reforms of the legal entities authorized as employment placement agencies, within twenty (20) working days following their adoption.
7. RECEIPT AND HANDLING OF COMPLAINTS AND GRIEVANCES
Users of the Employment Management and Placement Agency may submit their complaints and claims, which will be processed through the following procedure:
INSTRUCTIONS FOR HANDLING COMPLAINTS, CLAIMS AND REQUESTS:
Complaints and claims will be received in writing, verbally or by telephone through the following means:
- Customer service points: Carrera 15 Av. No. 88 - 64 Office 605.
- Customer service hotline: 60 1 7551991, 60 1 7559171.
- Laborintos website: https://laborintos.com in the contact section.
All complaints and claims received should be directed to the Customer Service Executive, a role that will be performed by the company's Administrative Assistant.
The Customer Service Executive will register the complaints or claims received in the Excel file called Complaints and Claims Register, recording the information related to the complaint:
- General data (name, ID or NIT, address, telephone, e-mail,)
- Means of receipt by which the complaint was received.
- Date of receipt of the complaint.
- Type of complaint (suggestion, claim, non-conformity).
- Service where the complaint occurred.
- General description of the complaint.
Once the customer's complaint or claim has been filled out in the Complaints and Claims Register, the Customer Service Executive will inform the area in charge of the service that originated the complaint, copying the Commercial Management and the General Management of the company. This communication must be made by e-mail no later than the next business day of receipt of the complaint.
The area in charge will analyze the causes that generated the complaint and will proceed to prepare a proposal for a written response to the complaint. Said proposal must be sent to the General Management and the Commercial Management within 5 working days from the moment the area in charge of the service that generated the complaint was informed by the Customer Service Executive.
The General Management and the Commercial Management will review the proposal and will approve it or request the adjustments they consider within the following 2 working days.
The Customer Service Executive will communicate the response by e-mail to the person who filed the complaint or claim no later than the business day after the response is approved by the General Management and the Commercial Management.
The Customer Service Executive will record in the Complaints and Grievances Register the date on which this final response has been communicated.
The Customer Service Executive follows up by telephone on the customer's satisfaction with the response or solution sent to the complaint. The record of this follow-up should be recorded in the Complaints and Claims Register.
8. LEGAL FRAMEWORK
Management and placement services shall be provided subject to the rules contained in these regulations, the provisions of Decree 0722 of April 15, 2013, Law 50 of 1990, Law 1636 of 2013, Decree 2852 of 2013 and the other rules that regulate labor intermediation in Colombia, as well as any other regulation that modifies, adds or repeals them.
GLOSSARY
Registration of Bidders: It is the registration of resumes virtually or in person in the computer system authorized to the provider.
Claimant Registration: It is the registration of the basic information of employers virtually or in person in the Computer System authorized to the provider.
Vacancy Registration: It is the registration of vacancies made by the Claimant virtually or in person.
Occupational Guidance: includes the analysis of the seeker's profile, general information on the labor market, information on employability programs, and advice on the development of job search strategies through the following instruments:
1. Psycho-technical tests associated with orientation.
2. Personalized or group orientation interview.
Workshops on basic competencies (key and cross-cutting).
4. Workshops on tools for self-employment.
5. Workshops on job search tools.
Applicant Orientation: It is the counseling provided to applicants/employers for the definition and registration of vacancies.
Pre-selection: It is the process that allows to identify among registered bidders, those who have the profile required by the vacancy.
Referral: This is the process by which the profiles of pre-selected candidates are sent or made available to the employer.
